Terms and Conditions

These Terms of Service (“Terms”) govern your access to and use of virtuecasa.com (the “Site”) and the virtual staging and related services provided by VirtueCasa LLC (“VirtueCasa,” “we,” “us,” “our”). By accessing the Site, placing an order, or using our services, you agree to these Terms.

If you do not agree, do not use the Site or purchase services.

2) Services

VirtueCasa provides digital/virtual staging and related visualization services for real estate marketing (the “Services”), delivered as digital image files. Turnaround times displayed on the Site (including “48–72 hours”) are estimates and may vary based on scope, complexity, revisions, and volume.

We do not provide brokerage, appraisal, legal, tax, or financial advice, and we do not guarantee listing performance, buyer interest, or sale outcomes.

3) Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase Services. You agree that information you submit to us is accurate and that you are authorized to submit it.

4) Orders, payments, and taxes

• Ordering: Services are purchased through our checkout flow (which may be hosted by a third-party commerce provider).

• Payment: You authorize us (and our payment processors) to charge your payment method for the total amount shown at checkout, including applicable taxes.

• Taxes: You are responsible for any taxes, duties, or levies not collected at checkout that may apply in your jurisdiction.

5) Client materials and submission requirements

To perform Services, you may need to provide photos, measurements, notes, style preferences, branding, and other content (“Client Materials”).

You represent and warrant that:

• you own or have the necessary rights/permissions to provide the Client Materials to us, and

• our use of Client Materials to deliver the Services will not infringe any third-party rights (including copyright, privacy, publicity, or trademark).

6) Revisions, change requests, and scope

Unless your purchased package explicitly states otherwise, the order includes one (1) reasonable revision round to correct staging choices consistent with the original brief (e.g., style, furniture swaps, minor placement adjustments). Additional revisions or scope changes (e.g., new room angles, significant redesign, replacing the underlying photo) may require additional fees and will extend delivery time.

7) Delivery and acceptance

Deliverables are provided digitally (e.g., via download link, email, or portal). You are responsible for reviewing deliverables promptly. If you believe deliverables do not materially match the agreed scope, notify us at darren@virtuecasa.com within 7 days of delivery with specific details.

8) Refunds and cancellations

Because Services are custom digital work:

• Before work begins: You may request cancellation for a full refund.

• After work begins: Fees are generally non-refundable, except where required by law or where we determine (in our discretion) that we cannot complete the order as promised.

If we miss delivery materially due to our fault and cannot remedy within a reasonable time, your exclusive remedy is a refund of the amount paid for the affected portion of the Services.

9) Intellectual property and licenses

Our IP. The Site, its content, templates, branding, and underlying workflows are owned by VirtueCasa or its licensors and are protected by intellectual property laws.

Deliverables license. Upon full payment, VirtueCasa grants you a non-exclusive, worldwide, non-transferable license to use the delivered staged images for:

• marketing, advertising, and promotion of the specific property listing(s) shown, and

• portfolio use by listing agents/teams, provided the images are not resold as standalone products.

Restrictions. You may not:

• sell, sublicense, or redistribute deliverables as a standalone asset (e.g., stock imagery),

• use deliverables to train AI models or datasets, or

• remove any embedded metadata/watermarks if included.

Portfolio. Unless you opt out in writing before delivery, you grant VirtueCasa permission to display deliverables (and/or before/after comparisons) in our portfolio and marketing materials. To opt out, email darren@virtuecasa.com before placing the order or before we begin work.

10) Prohibited uses

You agree not to:

• use the Site for unlawful, infringing, fraudulent, or deceptive purposes,

• interfere with Site operation or security (e.g., scraping, probing, malware),

• submit content that violates third-party rights, or

• misrepresent staged images as actual physical staging where disclosure is required by MLS rules, local regulations, or platform policies.

You are solely responsible for ensuring your use complies with MLS and advertising guidelines applicable to your listings.

11) Third-party services and links

The Site may integrate with or link to third-party services (e.g., checkout/payment providers). Those third parties have their own terms and privacy practices. VirtueCasa is not responsible for third-party services.

12) Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRTUECASA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that staging will increase views, leads, offers, or sale price.

13) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRTUECASA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

IN ALL CASES, VIRTUECASA’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO VIRTUECASA FOR THE ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14) Indemnification

You agree to indemnify and hold harmless VirtueCasa and its affiliates, officers, contractors, and employees from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from:

• your Client Materials,

• your misuse of the Site or deliverables, or

• your violation of these Terms or applicable law.

15) Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute not subject to a mandatory alternative process (if applicable) will be brought in the state or federal courts located in or nearest to Sacramento County, California, and you consent to personal jurisdiction there.

16) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the effective date. Continued use of the Site or Services after changes become effective constitutes acceptance of the updated Terms.
